INTRODUCTION AND STATUS

The following terms and conditions set out the basis on which all goods (or "Products") are sold by Underwater Explorers Ltd. trading online as DirDirect (or "We", "Us", "Our") to the consumer, ("You", "Your") from our primary website www.dirdirect.com (and all of its online redirects including www.dirdirect.eu / www.dirdirect.co.uk / www.dirdirect.info) ("Site"). Any purchase of our products will be governed by these Terms and Conditions.

www.dirdirect.com is an online e-commerce site with world-wide delivery maintained and run by the UK-based "brick and mortar" Underwater Explorers Ltd. dive store.

We are registered in England under company number 5591766. Our registered office is at Midland House, 2 Poole Road, Bournemouth BH2 5QY while our trading and physical address for contact is Underwater Explorers, Unit 1, Maritime Business Centre, Mereside, Portland, Dorset DT5 1FD, United Kingdom. Our VAT number is GB 684 884 471.

CONTRACT AND ORDERS

When placing an order with us, you are making an offer to purchase under these Terms and Conditions and agreeing to our, Privacy, Cookies, Shipping and Returns & Refunds policies. The Contract between us regulated by these Terms and Conditions commences only after we have agreed to the purchase offer and your order is dispatched.
You can cancel your order at any time prior to dispatch towards a refund though orders for certain items (i.e. items made and/or manufactured to order such as drysuits and undersuits) cannot be cancelled once re-confirmed by you. Exceptions are detailed in our Returns & Refunds Policy.
Any product(s) on the same order that are not dispatched do not form part of that contract, where any item(s) may be on backorder.
All products are subject to availability. We strive to list accurate dispatch times and maintain sufficient stock levels to ensure timely delivery. However, items may temporarily be out of stock or delays may happen due to stock errors or manufacturer supply chain issues. If your order is affected, we will notify you. You will have the option to wait or receive a full and immediate refund (or a partial refund for unavailable items). We cannot accept liability for delays caused by stock problems.
If a product or its variant on our site is listed as a Special Order, it means it will be ordered specifically for you from the manufacturer or distributor, and it is not a regular stock item. We reserve the right to refuse any returns of said product(s) outside of any defect or warranty issues, given that such item(s) are not part of the stock we keep in store, and returns will be subject to exceptions.
The description of any product is set out in the product listing on this site, but products shipped may slightly differ from the images as they are for graphic representation only.
We reserve the right to reject any offer at our discretion at any time. Online orders may be declined either in whole or in part at our absolute discretion, and in the event any such order is declined, any payment submitted with the order in UK pound sterling (GBP), partial or full, will be refunded immediately in UK pound sterling (GBP) to the full amount paid.
Property of the product(s) shall pass to you only after your payment has cleared and as of the date the product(s) have been delivered to you.
All of our listed product prices include UK VAT where applicable. Our online system automatically deducts VAT when shipping to international customers, and we have procedures in place to deliver to BFPO addresses.
Prices listed on our site are subject to change without prior notice, but such changes will not affect any purchases already made. Although we make every effort to ensure correct prices are displayed, erroneous pricing can occur. We reserve the right, at our discretion, either to contact you for instructions if this happens, or to cancel your order, refund, and notify you accordingly.
We will ship anywhere in the world, except Russia and Belarus, as well as regions where local or international restrictions/or online trading restrictions may apply. Most of our products are available for global delivery. Still, certain manufacturers (such as 4th Element, Apeks, Aqua Lung, Scubapro, etc.) have trading restrictions that limit our distribution to select territories for online orders.
High-value UK orders and orders from outside of the UK will only be dispatched to the registered or verified card billing address if a credit or debit card is used for purchase, and orders paid for by PayPal (and/or PayPal Credit) will only be shipped to PayPal verified addresses unless prior arrangements are made with us.
By placing an order through our site, you consent that under Data Protection regulations and to fulfil our contract with you, you must provide us with certain personally identifiable information, that our contractual obligation to you is our lawful basis to use and hold this information to process and conclude any order and that we can hold this information on encrypted/secure storage. Details of the information we require, for what purpose, how we use it and who has access to it are clearly listed in our Privacy and Cookies Policies.
By placing an order through our site, you warrant that you are legally capable of entering a binding contract between you and us and our respective successors and assigns. You also confirm that you are at least 18 years old and that you are aware of and accept our privacy, delivery and returns policies and terms as set out in these Terms and Conditions before purchasing from our site.
By placing an order through our site, you accept that professional training and certification from a recognised diving agency are required to use most of our products (and all products specifically designed for underwater use). Any scuba diving equipment you purchase from DirDirect is done so with the understanding that you are trained and qualified to inspect, prepare, maintain, and operate that equipment within your limits of training and experience, as well as the limits and purposes specified by the relevant manufacturer.
By placing an order through our site, you accept to adhere to manufacturer, training agency and industry recommendations on equipment maintenance and servicing inclusive of, but not limited to, regular visual inspection and functionality testing, lubrication and changing of any o-rings where required, fresh water rinsing against limescale, chlorine or salt water damage after every inland/pool/sea dive and similar protective measures that are required to operate and maintain equipment made for underwater use safely.
All diving-related products listed and sold on our site are for recreational use only, under the conditions listed above in (13), (14), (15) and are not to be used nor are they warranted for military, governmental, rental, or commercial purposes. Commercial and military customers must contact us directly for any arrangements or quotes.
We aim to protect legitimate credit card owners from fraud. We will therefore report to and cooperate with appropriate authorities investigating any person/entity attempting to use a card or payment method for which they are not authorised.
These Terms and Conditions do not affect your statutory rights and explicitly cover our Cancellations and Returns Policy and Warranty Policy, which include faulty/defective items, as well as our Direct Shipping Policy, which you are advised to read by using the links provided and are summarised for convenience below.
You are not entitled to assign or transfer any of your rights or obligations under this contract.
This contract shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.

CANCELLATIONS, RETURNS & REFUNDS

You can cancel your order at any time before dispatch towards a full refund, so long as it is not a special order or tailor-made item which is already in progress. For UK customers, we offer a goodwill extended returns policy for up to 30 days from the date of delivery for unused product(s).

International customers have the right to return a purchase within 14 days of delivery, provided the item is eligible for the statutory cooling-off period and is returned in unused condition, together with its original packaging and tags.

TERMS OF DELIVERY

All orders for in-stock items (listed as 1 to 2 day dispatch) will be processed within 2 working days for dispatch and delivery. We aim to dispatch all goods within 7 days of receiving your order and will notify you in writing if there are any exceptions. While we strive to deliver your order as quickly as possible, please allow 7 working days for UK deliveries and 14 working days for international deliveries. By proceeding to checkout you accept these terms which are outlined in detail in our Shipping Policy.

CONFIDENTIALITY AND SECURITY

We respect your privacy. In order to process and fulfil your order online, to enhance your user experience and provide you with information on our site and products, we require a certain amount of information which excludes any sensitive payment details which are handled by a secure encrypted online payment processing gateway or PayPal. By sharing this information and placing an order you consent to our Privacy Policy and the Cookies we use.
